Points-based driving license

The points-based driving license applies to everyone. Different limits apply to novice drivers than to experienced drivers, but the points-based driving license itself applies to every driver, regardless of whether they have a driver’s license.

The first penalty point

You will receive the first penalty point on your driving license if you are convicted of driving under the influence of alcohol or drugs, causing a traffic accident under the influence of alcohol or drugs, or refusing to submit to a breathalyser or blood test.
The first penalty point applies to all driver’s licenses. It therefore doesn’t matter whether you were convicted of driving a car, moped, or motorcycle under the influence of alcohol or drugs.

The second penalty point

You will receive the second penalty point if, within five years of the first penalty point, you drive again under the influence of alcohol or drugs, cause an accident under such influence, or refuse to submit to a breathalyser or blood test.
For driving under the influence of alcohol, a blood alcohol content of 1.3 (570 µg/L) or higher is required. If the alcohol level is less than 1.3 per mille (570 µg/L), the penalty remains one point, but the five-year period starts again.
Is the offence for which a second penalty point is imposed? And is the conviction final? Then the driver’s license is automatically invalidated. The only way to obtain a new license is to retake the theory and practical exam. In addition, a declaration of fitness from the CBR must be submitted. This means you must undergo an examination by a doctor appointed by the CBR. This part is very similar to the examination conducted in the so-called requisition procedure. Only when this doctor certifies that you are fit to drive can you obtain a new driver’s license.
