Recidivism regulation for alcohol and drugs
The second time a police check reveals that you have driven under the influence of alcohol and/or drugs, your driving license is automatically invalidated.
After an irrevocable conviction for drink-driving, a registration (also known as a penalty point) follows. For recidivism purposes, the following offences are registered:
- Driving under the influence of alcohol.
- Driving under the influence of drugs.
- Not cooperating with a breath analysis or blood test.
- Causing a serious traffic accident under the influence of alcohol or drugs, or failing to cooperate in a breath analysis or blood test.
If, after the first penalty, you are stopped for the second time within five years of using drugs, or with a blood alcohol level of more than 1.3, or refuse to cooperate with a breath analysis or blood test, your driving license will automatically become invalid.
To get your driving license back, you must first submit a health declaration to the CBR. Once the CBR grants permission, you must first pass the theory and practical exam again.
